I. Amendment of the Telecommunications Act:
The following amendments will get effective on March 1st, 2010:
Indication of price for 0180 numbers:
If there are other prices for calls from the mobile networks compared to the prices for calls from fixed networks, in addition to the fixed network price the maximum mobile network price has to be advertised.
Due to a Bundesnetzagentur decree calls from mobile networks to 0180-services only might be charged per minute. So for 0180-2 and 0180-4 numbers the price per call from the fixed network and the maximum price per minute from the mobile network have to be indicated.
0180-5: „0,14 Euro pro Minute aus dem Festnetz; maximal 0,42 Euro pro Minute aus den Mobilfunknetzen“
0180-2: „0,06 Euro pro Anruf aus dem Festnetz; maximal 0,42 Euro pro Minute aus den Mobilfunknetzen“
Maximum prices for 0180 numbers:
- From the fixed network 0,14 Euro per minute or 0,20 Euro per call at the most.
- From the mobile network 0,42 Euro per minute or 0,60 Euro per call at the most.
II. Law against unauthorized telemarketing:
The following amendments got effective on August 4th, 2009:
Forbidden Calling Line Identity Restriction for telemarketing:
The calling line identity must not be restricted for advertisments via telephone calls.
It´s not allowed to send Premium Rate Service numbers (eg. 0900, 0137) as calling line identity! The following number ranges can be used: Landlines, Free Call numbers, Shared Cost numbers
Telemarketing targeted at consumers:
Advertisements via calling consumers by phone without their expressly prior permission are forbidden.
